Terms and Conditions for Tree Surgeons Bethnalgreen

Tree surgeons preparing a site for arboricultural workThese Terms and Conditions set out the basis on which tree surgery services are provided by Tree Surgeons Bethnalgreen. By making a booking, confirming a quotation, or permitting work to begin, the customer agrees to be bound by these terms. These conditions are intended to create clarity around the service arrangement, including the booking process, payments, cancellations, liability, waste handling, and the governing legal framework. They should be read carefully before any work is scheduled.

The terms apply to all domestic and commercial customers, whether the requested service involves pruning, crown reduction, stump removal, felling, hedge maintenance, inspections, emergency response, or related arboricultural tasks. For the avoidance of doubt, references to Tree Surgeons Bethnalgreen, we, us, and our mean the service provider carrying out the works, and references to you or the customer mean the person or organisation placing the order.

Professional tree surgery team arranging equipment and accessAny deviation from these terms must be agreed in writing before the work starts. If a quotation, estimate, or written arrangement conflicts with these terms, the specific written agreement will apply only to the extent that it expressly changes the relevant point. All other terms remain in force. These conditions are designed to be fair and reasonable and to reflect standard practice in the UK tree surgery sector.

1. Booking Process

The booking process begins when the customer makes an enquiry and provides relevant details about the site, the tree work required, access conditions, and any known restrictions. We may request photographs, measurements, or other information to assess the likely scope of the service. In some cases, a site visit may be necessary before a quotation can be issued. Any quotation provided is based on the information available at the time and may change if the actual conditions differ materially from those described.

A booking is only confirmed when the customer accepts the quotation and we confirm the appointment, either verbally or in writing. A confirmed booking reserves time, equipment, labour, and planning resources. The customer is responsible for ensuring that the property is accessible on the agreed date and that any persons with authority to approve the works are aware of the arrangement. If access is obstructed or if the customer is not present where their presence is required, the visit may be treated as a late cancellation or failed appointment.

2. Customer Responsibilities Before Work Starts

Arborist carrying out tree work under safe operating conditionsThe customer must ensure that all relevant information is disclosed before work begins, including the presence of underground services, protected trees, nesting birds, hazardous structures, weak ground, concealed obstacles, or any condition that may affect safety or execution. The customer should also confirm whether permission, consent, or approval is needed from a landlord, managing agent, freeholder, local authority, or any other third party. Unless expressly agreed otherwise, the customer is responsible for obtaining all required permissions and consents.

We may suspend or refuse work if we reasonably believe that proceeding would be unsafe, unlawful, or outside the agreed scope. If additional time, equipment, or specialist methods become necessary because the customer has withheld important information or because conditions are substantially different from those disclosed, additional charges may apply. Any such variation will be discussed where reasonably practicable before the extra work is undertaken.

3. Pricing and Payments Our prices are normally based on the quotation supplied, the size and condition of the tree or trees, access, waste volume, labour required, equipment use, and the complexity of the task. Unless otherwise stated, quotations are valid for a limited period and may be withdrawn or revised if the work is not accepted within that period. Prices may be adjusted where the scope changes, where unforeseen hazards arise, or where the customer requests additional services.

Payment terms will be stated on the quotation or invoice. Unless otherwise agreed in writing, payment is due on completion of the work and must be made in cleared funds. For larger commercial jobs or works requiring advance resource allocation, we may request a deposit or staged payments. All deposits are applied against the final invoice unless the booking is cancelled in accordance with these terms. Late payment may result in interest and recovery charges where permitted by law. We reserve the right to withhold certificates, reports, or post-work documentation until outstanding sums are paid in full.

4. Cancellations and Rescheduling

The customer may request a cancellation or rescheduling by giving notice as early as possible. If notice is provided with reasonable time to reallocate the slot, we will usually accommodate a new date subject to availability. However, because tree surgery work often involves scheduling staff, machinery, and waste transport in advance, short-notice cancellations may attract a charge to cover losses reasonably incurred.

If the customer cancels after work materials have been ordered, specialist equipment arranged, permits obtained, or labour mobilised, we may retain part or all of any deposit to cover administrative and operational costs. If our team arrives at site and is unable to proceed because of access failure, unsafe conditions not disclosed in advance, absence of required permission, or customer unavailability, this may be treated as a cancellation by the customer and charged accordingly.

5. Right to Amend or Withdraw We reserve the right to amend, postpone, or withdraw a booking where necessary for safety, weather conditions, staff availability, equipment failure, or legal compliance. Tree surgery can be highly weather-sensitive, and strong winds, heavy rain, ice, or other adverse conditions may make work unsafe or impractical. In such circumstances, we may rearrange the appointment without liability for indirect losses. We will seek to notify the customer promptly and offer a revised date where feasible.

6. Liability and Risk

Our work is carried out with reasonable skill and care by trained personnel using appropriate methods and equipment. However, tree surgery involves inherent risks, including falling branches, woodchip spread, stump disturbance, soil compaction, and incidental contact with nearby surfaces or vegetation. The customer accepts that some disruption is a normal consequence of the service. Minor scuffs, marks, or disturbance reasonably associated with access or completion of the agreed work will not usually amount to negligence.

We will not be responsible for pre-existing defects, hidden decay, underground obstructions, unstable structures, or damage caused by information omitted by the customer. We are not liable for indirect or consequential loss, including loss of profit, business interruption, or loss arising from third-party claims, except where such exclusion is not permitted by law. Nothing in these terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded or limited.

If we identify a tree as hazardous and recommend urgent action, the customer remains responsible for deciding whether to accept that recommendation. Where a customer chooses not to proceed with recommended remedial work, they do so at their own risk. We do not accept liability for incidents that occur after advice has been declined, unless the incident was caused by our own negligent act or omission in the work we actually carried out.

7. Site Conditions, Property Protection, and Access

The customer must provide safe access to the work area and remove or protect items that could be damaged by routine tree surgery activity, including vehicles, ornaments, garden furniture, fragile coverings, or loose outdoor items. Where requested, we may take reasonable precautions to minimise disruption, but we are not responsible for moving items that were not identified in advance or for damage arising from the customer’s failure to protect vulnerable property.

We may need to use ladders, climbing systems, ropes, chippers, stump grinders, or other specialist equipment. The customer agrees not to interfere with plant or machinery and not to enter restricted work zones unless invited by our operatives. If children, pets, or unauthorised persons are present, we may pause the work until the area is made safe. Any delay caused by the customer may result in additional charges if it increases labour time or equipment hire.

8. Waste Handling and Regulations

Final checks after tree surgery with equipment and cut timberAll green waste removed during the service will be handled in accordance with applicable UK waste regulations. Unless otherwise agreed, timber, branches, leaves, and arisings generated by the work become our responsibility once removed from site, and we will transport them to authorised facilities or arrange lawful reuse, recycling, or disposal. We aim to reduce waste wherever reasonably practicable and to comply with environmental duties concerning segregation and transfer.

The customer must not instruct us to dispose of waste unlawfully or to leave materials in a manner that would breach local rules, environmental requirements, or landowner obligations. If the customer requests that logs, timber, or arisings remain on site, this must be agreed in advance. Any such arrangement is subject to site suitability and may require separate handling. Where timber is retained by the customer, it is accepted in its condition at the point of handover and thereafter becomes the customer’s responsibility.

We may retain or dispose of diseased, infested, contaminated, or hazardous material in a manner consistent with legal obligations and good practice. The customer acknowledges that certain tree waste may require special handling if pests, pathogens, or contamination are suspected. Where required by law, transfer notes, carrier details, or other records may be maintained internally in line with regulatory requirements.

9. Complaints, Defects, and Follow-Up Matters Any issue regarding the quality of the service should be raised promptly and in any event within a reasonable time after completion. We may ask for photographs or a site inspection to assess the matter. If a genuine defect in our workmanship is identified, we may, at our discretion, return to rectify it, offer a partial refund, or agree another fair remedy. This does not apply where the issue arises from normal tree response, weather, root movement, subsequent site changes, or third-party interference.

10. Warranties and Service Limitations

Although we take care to provide a professional tree surgery service, trees are living organisms and can respond unpredictably to pruning, reduction, felling, or stump work. No guarantee is given that a tree will remain stable, healthy, or free from future defects after the service unless this has been expressly agreed in writing and is capable of being guaranteed. Natural growth, seasonal variation, and environmental stress may affect results.

Any advice given by our team is based on observations at the time and should not be treated as a permanent warranty unless expressly stated. Where we provide opinions on tree health, safety, or likely future condition, these are professional assessments only and are not a substitute for broader surveying, planning, or legal advice. The customer should seek independent advice where specialist legal, planning, or insurance issues are involved.

11. Events Outside Our Control We shall not be in breach of these terms if performance is delayed or prevented by events outside our reasonable control, including severe weather, accidents, road closures, equipment breakdown, illness, civil disturbance, utility failure, or supply delays. Where such events occur, we will use reasonable efforts to resume or reschedule the work as soon as practical. We will not be responsible for losses arising solely from those events, provided we have acted reasonably.

12. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of England and Wales. Any dispute arising from or connected with the service, quotation, booking, payment, or performance of the work shall be subject to the exclusive jurisdiction of the courts of England and Wales. If any provision is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

The customer and Tree Surgeons Bethnalgreen both agree that these terms form the entire agreement between the parties in relation to the service, unless varied in writing. Any failure to enforce a right under these terms on one occasion does not waive that right in future. Headings are included for convenience only and do not affect interpretation. These terms may be updated from time to time, and the version applicable will generally be the one in force at the time the booking is confirmed.

By accepting a quotation or permitting work to begin, the customer confirms that they have read, understood, and agreed to these terms. If the customer does not agree, they should not proceed with the booking. These terms are intended to support a clear and lawful working relationship for all tree surgeon services provided under the Tree Surgeons Bethnalgreen name.
